Of concern here, IMHO, is that the intruder is not described as being threatening. We don't have all the facts, of course, and those we do have DO support his actions: unknown person in home uninvited at 2AM, yes, I can see how the homeowner would think that this person was a threat and I agree he responded appropriately given the circumstances we know. What the homeowner had no way of knowing to be true is that the man was involved in a car collision. Was he looking for help? The only thing that will define either way is when the testimony is taken, if the intruder reports that he held his hands up and identified that he was not a threat, but even then, he should stay at gunpoint until the law arrived to collect him, provided that the homeowner was not so terrified at the situation that he couldn't think clearly.
To be clear, I don't mean to second-guess the homeowner, as I was not there and don't have the facts. The Monday morning quarterback can always report that he would've done the right thing, but it's a lot tougher when you're down on the field and can't look at what happened in the rest of the game you're still playing.
