Because its CLEVELAND, where all guns are bad, and all gun owners are evil.
Not sure what the laws are in Ohio, but it sounds like the homeowner shot as the guy was running from him, not towards him. In some places, that may be a problem.
Guns used in shootings are routinely seized by police to be thurough in the investigation. Usually the investigation would be submitted to the DA / Grand Jury to see if the shooter committed a crime. If not, he gets his gun back, or at least he would in most places. Not sure about the People's Republik of Cleveland.
The shooter said he shot at the guy's feet, to scare him????? I must have missed that part in gun safety 101. Sounds like the gun owner needs a class in what not to do. :roll:

Well, I don't approve of the law taking away any citizen's gun unless it's in conjunction with an arrest.
However, in this case, I'm not so sure the guy should have a gun if he can't do better with it than he did.
His stated intention is ludicrous. He just wanted to "scare" the bad guy. That is most definitely NOT what guns are for. Anyone who thinks he has a gun for the purpose of waiving it around and scaring people, even bad people, shouldn't have a gun. My opinion is that one should never pull out a gun unless one intends to use it. Then, use it. That means, by the way, one should never pull a gun except in a situation that would justify using it. And, of course, never try to shoot your adversary in the leg. That may just make him angry.
