NEW ORLEANS — Federal prosecutors may have overreacted in their case against two Border Patrol agents who were sentenced to lengthy prison terms after jurors convicted them of shooting a fleeing drug suspect and hiding evidence of the incident, an appeals court judge said Monday.

It is some what off- CCW - but kind of related as the open border is a open source of security problems for every American.

What do you all think about the Border Agents and what should have been done? Thanks.

The more I read of this case, the angrier I get. Two LEOs, tasked to safe our borders against invasion, drug traffickers, etc., do their jobs. They find a felon and, tasked to apprehend him, they pursue. When one testifies that he thought he saw a firearm in the perp's hand, and indeed, in a separate account, I read that the bullet wound on the perp's backside is consistant with him being turned as if to fire at a pursuer.

Fast forward, now we have the criminal come forward, admit to the incident, and he's promised immunity in return for his testimony. I'll grant that the agents should not have policed their brass, and they should have filed a written report in addition to telling their on-scene superiors. All that said, though, We have a criminal running free and two LEOs behind bars.

and the whole thing could be prevented by ending the failed "drug war" and sealing the da*n borders!!!

I get livid every time I'm reminded of this case. It makes me crazy. These border patrol agents were out their risking their lives for me. They were just doing their jobs. Nothing unusual. They ordered a suspect to stop and surrender, and instead the suspect turned and ran. They shot him. So? Isn't "police shoot fleeing suspect" an everyday occurrence? I want our police and border patrol agents to shoot fleeing suspects. The only proviso would be public safety issues that would make shooting dangerous to bystanders in a particular situation. Otherwise, shoot them.
